Soundreef Ltd is committed to protecting the privacy of visitors, members, and registrants that access this website or provide information through it. Throughout this Privacy Policy, the terms “Soundreef”, “we”, “us” and “our” refer to Soundreef Ltd the following sets forth our information gathering and disclosure practices.

COLLECTION OF PERSONAL INFORMATION

In certain parts of this website, we may ask you to provide us with your name, mailing address, E-mail address, Soundreef name, phone number, social security number, tax information, birth date, place of birth, and other personal information. We collect certain usage information about our website, such as the number and frequency of visitors to certain parts of the website. Soundreef Ltd may provide aggregate statistics about our users’ traffic patterns, the number of members who have signed up with Soundreef, the different types of copyright owners and artists that comprise our membership pool, and related site information to third-parties, but this information will not include personally-identifiable information.

USE OF PERSONAL INFORMATION

If you are registered with us, we will use your personal information to ensure we properly collect and pay you for earned royalties. We may also use your information to respond to requests for technical support, to provide registered users with access to and use of our Radio Channel Engine, to improve the Soundreef service, to send you communications including newsletters and other notifications, and for other uses consistent with Soundreef’s business purposes. From time to time, Soundreef participates in political advocacy regarding important intellectual property ownership and performance rights. We may send you emails to seek your involvement and assistance in campaign activities, such as signing petitions or surveys, or sending emails including your information to political representatives. If you have questions about, or would like to opt out of, one or more of the ways Soundreef plans to use your personal information or keep you up to date about its operations, activities and services, please send an email to: [email protected] giving details of your request.

We may enter into legal agreements with third parties who either: (a) provide vendor services to us (e.g. data management, billing, and storage services) or, when necessary, (b) assist us in completing or effectuating payment of royalties (e.g. sharing personal information to ensure payment is made properly).In either circumstance, we disclose personal information only to the extent it is necessary and in accordance with applicable laws and regulations, and we further secure the agreement from  the third party that it will maintain the confidentiality of your personal information. Soundreef does not otherwise share, nor does it sell, trade or rent, your personal information to third parties.

Any personal information will only be used in accordance with this Privacy Policy.  We are committed to protecting your privacy. If you are resident in the European Union we will only use the information that we collect about you lawfully (in accordance with the EU Privacy and Communications Directive). This includes information submitted voluntarily by you either offline or gathered automatically as you visit the website.

You should not submit any sensitive or private information through this website except through acknowledged secure areas. The owners of the website accept no responsibility for data submitted through insecure areas of the website.

SECURITY

Although Soundreef uses all reasonable efforts to safeguard your personally-identifiable information, transmissions made by means of the Internet cannot be made absolutely secure. All third parties that provide services for us are obligated to protect your personal information in accordance with Soundreef’s Online Membership Form which provides copyright owners and featured artists with the ability to register for Soundreef royalties electronically and to sign our Membership Agreement(s) electronically. Registrants will need to enter specific, personal information about themselves and may be asked to provide specific information about the sound recordings which they own or on which they performed. Any such personally-identifiable information can be modified at your request as set forth in the Online Registration Form. By signing up through the Online Membership Form, you authorize Soundreef to be your non-exclusive agent and to use this information to collect and distribute royalties. This means, among other things, that you authorize us to share such registration information subject to and in accordance with the provisions of this policy with other organizations as necessary in furtherance of collecting, and/or distributing and effectuating payment of royalties. Soundreef may also use the information for internal purposes in order to facilitate software and process development. All information provided to Soundreef through the Online Membership Form is stored on secure systems not accessible to the public. A third party vendor maintains and operates the system, which is also obligated to protect your personal information in accordance with Soundreef’s policies, except if we inform you otherwise at the time of collection.

DISCLOSURE OF PERSONAL INFORMATION

Except as described herein, we will only make your personal information available to non-affiliated third parties in the following circumstances: (1) If we are compelled to do so by law or by a governmental agency, court or other official entity (e.g. to respond to subpoenas, court orders or legal process); (2) If we believe your actions violate a law, regulation, this Privacy Policy or any applicable Website terms of use; (3) If you threaten the rights, property or safety of us, our Website, any other users or third party.

VISITORS UNDER THE AGE OF 13

Soundreef does not knowingly collect any personally identifiable information from anyone under the age of 13 years old. If a child under 13 submits personal information to Soundreef and we learn that personal information is the information of a child under 13, we will attempt to delete the information as soon as possible.

COOKIES INFORMATION

When you visit the Website, we may send one or more cookies – a small text file containing a string of alphanumeric characters – to your computer that uniquely identifies your browser and allows Soundreef to help you log in faster and enhance your navigation through the Website. A cookie does not collect personal information about you.

Soundreef uses both session cookies and persistent cookies. A persistent cookie remains on your hard drive after you close your browser. Persistent cookies may be used by your browser on subsequent visits to the Website. Persistent cookies can be removed by following your web browser’s directions. A session cookie is temporary and disappears after you close your browser. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent.

Some cookies are necessary to enable our Website to provide functions such as remembering your shopping bay items. Others are desirable as they remember choices you make such as language and search parameters, such as size, colour or product line and collect information about your browsing habits in order to help us and advertisers make suggestions relevant to you and your interests. They remember the websites you have visited and that information is shared with other parties such as advertisers. For example we use third parties to provide you with more personalised advertisements when visiting other websites. Other cookies help us to analyse how users navigate the website. None of these cookies show personal details from which your individual identity can be established. Some features of the Service may not function properly or at all if the ability to accept cookies is disabled. Cookies are also used on this website for the following third party services: Facebook Like and Share Button, Twitter Follow and Retweet button, Google +1 button, and if videos are embedded from sites such as YouTube of Vimeo etc, they may set their own cookies that are beyond our control. Some of these services may be used to track your behaviour on other websites and we have no control over this.

The Website will comply with Do Not Track browser settings, where supported, for certain cookies. Cookies with a red asterisk next to their names will not be set if your browser has Do Not Track enabled, even if you have accepted cookies.

YOUR RIGHTS AND YOUR PERSONAL DATA

If you are a natural person (that is to say an individual), you have the following rights with respect to your personal data. When exercising any of the rights listed below, in order to process your request, we may need to verify your identity for your security. In such cases we will need you to respond with proof of your identity before you can exercise these rights.

The right to access information we hold on you At any point you can contact us to request the information we hold on you as well as why we have that information, who has access to the information and where we obtained the information from. Once we have received your request we will respond within one month. There are no fees or charges for the first request but additional requests for the same data may be subject to an administrative fee.

The right to correct and update the information we hold on you. If the data we hold on you is out of date, incomplete or incorrect, you can inform us and your data will be updated.  Details about retention periods can currently be found on the ICO (Information Commissioner’s Office) website

The right to have your information erased If you feel that we should no longer be using your data or that we are illegally using your data, you can request that we erase the data we hold. When we receive your request we will confirm whether the data has been deleted or the reason why it cannot be deleted (for example because we need it for our legitimate interests or regulatory purpose(s)).

The right to object to processing of your data. You have the right to request that we stop processing your data. Upon receiving the request we will contact you and let you know if we are able to comply or if we have legitimate grounds to continue to process your data. Even after you exercise your right to object, we may continue to hold your data to comply with your other rights or to bring or defend legal claims. If the data is needed to enable us to comply with a contract we have with you then if we can no longer perform the contract we may notify you to say that the contract will need to be terminated if you maintain your right to object to the processing of your data.  We will give you a reasonable period to consider what you want to do and if you maintain your view then we may notify you that the contract will need to be terminated.

The right to data portability. You have the right to request that we transfer some of your data to another controller. We will comply with your request, where it is feasible to do so, within one month of receiving your request.

The right to withdraw your consent to the processing at any time of any data to which consent was sought. You can withdraw your consent easily by telephone, email, or by post (see Contact Details below).

The right to object to the processing of personal data where applicable.

The right to lodge a complaint with the Information Commissioner’s Office.

If we wish to use your personal data for a new purpose, not covered by this Data Protection Notice, then we will provide you with a new notice explaining this new use prior to commencing the processing and setting out the relevant purposes and processing conditions. Where and whenever necessary, we will seek your prior consent to the new processing.

OPT-OUT

You may opt out of:  (a) receiving email communications such as email newsletters and promotional emails by following the instructions provided at the bottom of each email, clicking the “unsubscribe” button at the bottom of emails we sent you; or (b) receiving promotional email communications by emailing us at [email protected].  Please allow up to ten (10) business days for changes to your email preferences to take effect.  During that time, you may continue to receive email communications from us that were already in process.  Opting out of receiving website communications will not affect your receipt of service-related communications such as payment confirmations.

Registered users who have provided their cell phone number to us may remove it from within their personal profile settings. If you prefer not to receive text or wireless promotional communications on your mobile device, you can opt out by replying STOP.

You may ask us to delete your Personal Information from our system, however, because we archive and keep track of past transactions, you cannot delete information associated with past transactions or archived information on the Website(s).  Please also update your Personal Information if it changes.

Registered users may terminate their registration at any time, for any reason, by contacting us. Terminating your registration will not necessarily remove previous public comments or other user content on public display on the Website(s).  You understand it may be impossible to delete Personal Information entirely because of backups and records of deletions.  If you wish to cancel your subscription/account on the website or delete your Personal Information previously provided to us, you may send your request to us at [email protected] and indicate in the body of your communication your request.

If you do not receive a response from us to any emails you send to us within ten (10) business days, please send us another email as your original email may not have been received

LOG FILE INFORMATION

Log file information is automatically reported by your browser each time you access a web page. When you register with or view our Website, our servers automatically record certain information that your web browser sends whenever you visit any website. These server logs may include information such as your web request, Internet Protocol (“IP”) address, browser type, referring / exit pages and URLs, number of clicks, domain names, landing pages, pages viewed, and other such information.

CHANGES TO THIS PRIVACY POLICY

Soundreef reserves the right, at its sole discretion, to change, modify or otherwise alter this Privacy Policy at any time. Such changes and/or modifications shall be posted on the Soundreef website and shall be effective immediately upon the posting thereof. Please review this Privacy Policy periodically. Your continued use of the Soundreef website and online membership following the posting of changes and/or modifications to this Privacy Policy will constitute your acceptance of the revised policy.
