Since it\u2019s<br \/>\nexpensive and impractical for artists, labels and publishers to manage these rights<br \/>\nthemselves, most ask a collecting society to administer them. For more about<br \/>\ncollecting societies, see our&nbsp;<a href=\"http:\/\/www.soundreef.com\/en\/blog\/1\/music-industry\/what-is-a-copyright-collecting-society-and-what-does-it-do\" target=\"_blank\" rel=\"noopener noreferrer\">previous blog post<\/a>.<\/i><\/p>\n<p>This article will explain what rights an<br \/>\nartist has in relation to his or her songs, what can be done with them and which<br \/>\nof these rights can be managed by collecting societies.<\/p>\n<p><b>What rights does my song have?<\/b><\/p>\n<p>Every song has two main set of rights as<br \/>\nsoon as it is created: <\/p>\n<\/p>\n<ul>\n<li><span style=\"line-height: 1.45em;\"><b>Composition rights. <\/b>This means the rights to<br \/>\nthe actual idea for the composition (that is, the idea for an artist\u2019s song).<br \/>\nIn the past, musicians wrote their songs down on paper and these rights were<br \/>\ndesigned with this in mind. Most songs are now written electronically, rather<br \/>\nthan on paper, so this concept has become increasingly difficult for artists to<br \/>\nunderstand, even though it is possibly the most important type of right they<br \/>\nhave in relation to their music. Composition rights usually belong to the person<br \/>\nwho wrote the music for the song, and the person who wrote the lyrics for it.<br \/>\nThe composition rights are often partly assigned &nbsp;to a publisher by the composers. This is so<br \/>\nthat the publisher can help the composers publish their song via a record label,<br \/>\nor administer the royalties the composer receives when the song is used<br \/>\ncommercially<\/span>.<\/li>\n<li><span style=\"line-height: 1.45em;\"><b>Sound recording rights.<\/b> The right to the<br \/>\nsound recording is created when a song is recorded. The person or company that<br \/>\nhas recorded the song usually owns this. Traditionally, the right to the sound<br \/>\nrecording belongs to the record label who helped the musician to record the<br \/>\nsong \u2013 that is, the company that paid for it. The distinction between<br \/>\ncomposition rights and sound recording rights is becoming weaker, since<br \/>\nmusicians tend to write and record their music on their own computers, and usually<br \/>\ndon\u2019t need someone else to record their music or pay for it to be<br \/>\nrecorded.<\/span><\/li>\n<\/ul>\n<p><b>Do I own these rights?<\/b><\/p>\n<p>If you wrote both the music and the lyrics,<br \/>\nthen you own 100% of the composition rights; and if you recorded your song<br \/>\nyourself on your computer, or paid for studio time to record it, you own 100%<br \/>\nof the sound recording rights. If these composition and sound recording rights<br \/>\nbelong to you, then you don\u2019t need to license or sell those rights if you don\u2019t<br \/>\nwant to. <\/p>\n<p>Whatever people tell you, you must remember<br \/>\nthat you can choose whom you want to use those rights and the terms of the<br \/>\nagreement. If a company you want to work with tells you that you have to assign<br \/>\n50% of your rights to a publisher, or that you have to assign certain rights to<br \/>\na collecting society or something similar, remember that you don\u2019t<br \/>\nhave to do it! You own your rights in the same way as you own your instrument: they<br \/>\nare yours and you can choose what you do with them. There are no rules that you<br \/>\nhave to follow when you sell or license your own rights \u2013 you<br \/>\nonly need to follow rules after you\u2019ve signed a licensing agreement. <\/p>\n<p><b>What type of rights do collecting societies<br \/>\nmanage? <\/b><\/p>\n<p>As well as managing composition and sound<br \/>\nrecording rights, collecting societies manage other rights on behalf of<br \/>\nartists, labels and publishers. These are:<\/p>\n<\/p>\n<ul>\n<li><span style=\"line-height: 1.45em;\"><b>Digital rights. <\/b>These rights relate to music<br \/>\nbeing used on the internet. For example, streaming via platforms such as Spotify,<br \/>\nYouTube and internet radio.<\/span><\/li>\n<li><span style=\"line-height: 1.45em;\"><b>TV rights. <\/b>If a film is shown on TV and the<br \/>\nfilm has a right holder\u2019s song in it, the right holder should be able to collect their royalties<br \/>\nthrough their local collecting society.<\/span><\/li>\n<li><span style=\"line-height: 1.45em;\"><b>Radio rights.<\/b> Right holders should be paid<br \/>\na royalty when their songs are broadcast on the radio.<\/span><\/li>\n<li><span style=\"line-height: 1.45em;\"><b>The right to create CD copies.<\/b><\/span><\/li>\n<li><span style=\"line-height: 1.45em;\"><b>Live events rights.<\/b> Right holders should be<br \/>\npaid a royalty each time their songs are played in a concert.<\/span><\/li>\n<li><span style=\"line-height: 1.45em;\"><b>Background music rights.<\/b> Right holders<br \/>\nshould be paid a royalty each time their song is played in a store.<\/span><\/li>\n<\/ul>\n<p>These rights might be given different names<br \/>\nin copyright law and in a collecting society\u2019s agreement,<br \/>\nso make sure you understand what each term means in any agreement you sign. <\/p>\n<p>Traditionally, European collecting<br \/>\nsocieties made an agreement with artists which meant that the society<br \/>\nadministered all these rights as one bundle, and would only agree to work with<br \/>\nartists if they could do this. However, things are changing and artists are starting<br \/>\nto unbundle these rights. In the same way that you don\u2019t have to buy<br \/>\na mobile phone, landline, fax, cable TV and broadband from the same company,<br \/>\nyou don\u2019t have to ask one collecting society to handle all the rights to<br \/>\nyour music. Some artists, labels and publishers still find it useful just to<br \/>\ndeal with one company, but it generally isn\u2019t the best<br \/>\nway, especially if they want to make money from their music and get it heard.<\/p>\n<p>You should be able to license your music to<br \/>\nthe best company for you, depending on the level of service you receive for each<br \/>\nspecific music right.
